There are two types of surrogacy: traditional surrogacy and gestational surrogacy.

Traditional surrogacy (which is not usually practiced with surrogacy agencies) is when a woman is artificially inseminated to become pregnant. The woman shares  DNA with the baby.

The more common type of surrogacy is gestational surrogacy. Gestational surrogacy is when the surrogate is not related to the baby. The individual or couple will either use their own egg or donor egg.

Legal procedures for Gay Parenting

Common legal procedures for gay and single male parenting :


  1. Pre-Birth Order (PBO): A court proceeding that establishes parental rights prior to the birth of the child. PBOs are only available in certain states. In other states, it may be possible to obtain a post-birth order.
  2. Voluntary Acknowledgement of Paternity: Allows a birth mother to designate a father, sometimes without the need for a court proceeding.
  3. Custody Order: Grants custody of a child to the intended parent(s).
  4. Second-Parent Adoption: Permanently establishes the non-biological parent’s rights to the child. It’s advisable to obtain a second-parent adoption. 


U.S. Surrgacy law is complex and varies by state,Use a Filipino surrogate, usually apply to 2 and 4. It’s vital that you consult with a lawyer who specializes in surrogacy for LGBTQIA+ couples and singles.

Matching a Surrogate Mother

Matching a surrogate mother is one of the most exciting milestones during your surrogacy journey to parenthood.


8 criteria to consider when choosing your surrogate:

LESBIANS COUPLE &SINGLE FEMALE IVF

Reciprocal in vitro fertilization (IVF) for lesbians allows both women to participate in the pregnancy. One woman supplies her eggs, retrieved and fertilized by donated sperm in IVF, with the resulting embryo(s) implanted into her partner for pregnancy as a gestational carrier.

Single woman IVF, have the option to become pregnant by themselves using donor sperm or they can also use donor egg and a surrogate mother.


The following are relevant to them:

SPAR FOR HIV PARENTS

The Special Program of Assisted Reproduction (SPAR) is an international program designed to protect wives, surrogates and babies from becoming infected during fertility procedures that use sperm from men who wish to have children of their own, but are living with a sexually transmitted disease, such as HIV, Hepatitis B and C, and cytomegalovirus (CMV) will test positive for the infectious agent.


SPAR is offered in conjunction with the Bedford Research Foundation Clinical Laboratory, headed up by Dr. Ann Kiessling. which has helped bring over 300 babies into the world safely through the program with no transmission of the virus.


Living with HIV doesn't prevent you from having a child safely through surrogacy. Through  SPAR, we have helped 9 HIV parents fulfill  their dreams of parenthood, including two Chinese HIV parents.
